Welcome to Lots to Shop. This Governing Law & Jurisdiction Policy forms part of our Terms & Conditions and applies to all users of the Lots to Shop website, including buyers, sellers, visitors and any person accessing or using our marketplace.
By accessing or using Lots to Shop, you agree that this policy governs your use of the platform.
- Governing Law
Lots to Shop is owned and operated in the Republic of South Africa.
All use of this website, all transactions conducted through the marketplace, and any disputes arising from the use of the platform shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.
- This includes, where applicable, but is not limited to:
- The Consumer Protection Act, 68 of 2008 (CPA).
- The Electronic Communications and Transactions Act, 25 of 2002 (ECTA).
- The Protection of Personal Information Act, 4 of 2013 (POPIA).
- The Cybercrimes Act, 19 of 2020.
- Any other applicable South African legislation.
- Jurisdiction
Any dispute arising from the use of Lots to Shop, the purchase or sale of products, payments, services or these Terms shall fall under the jurisdiction of the courts of the Republic of South Africa.
Users agree that any legal proceedings shall be instituted within the appropriate South African court having jurisdiction over the matter.
Nothing contained in this policy limits any rights that consumers may have under applicable South African law.
- Marketplace Role
Lots to Shop provides an online marketplace where independent sellers may advertise and sell products to buyers.
Lots to Shop is not the owner of products listed by sellers unless expressly stated.
While we facilitate transactions, payment processing and customer support, the sales contract for listed products is concluded between the buyer and the independent seller.
Lots to Shop reserves the right to intervene where necessary to investigate disputes, protect users and enforce marketplace policies.
- Dispute Resolution
Before commencing any legal proceedings, users agree to first contact Lots to Shop Customer Support so that we may attempt to resolve the matter fairly and efficiently.
Where appropriate, Lots to Shop may:
- Request additional information from either party.
- Review courier tracking information.
- Review communication between buyer and seller.
- Request supporting evidence such as photographs or documentation.
- Facilitate discussions between buyers and sellers.
- Make a determination in accordance with our Buyer Protection Policy, Returns & Refund Policy and Terms & Conditions.
- Our goal is always to resolve disputes fairly while protecting both buyers and sellers.
- Buyer Protection
Transactions completed through the official Lots to Shop checkout are subject to our Buyer Protection Policy.
Buyer Protection includes secure payment processing, order protection and dispute assistance in accordance with our published policies.
Payments made directly between buyers and sellers outside the Lots to Shop platform are not covered by Buyer Protection and are undertaken entirely at the user’s own risk.
- Electronic Communications
By using Lots to Shop, users consent to receiving communications electronically.
Electronic agreements, invoices, notices, records, confirmations and communications satisfy any legal requirement that such communications be in writing where permitted by South African law.
- Intellectual Property
All trademarks, branding, logos, software, graphics, website design, content and intellectual property belonging to Lots to Shop remain the exclusive property of Lots to Shop unless otherwise stated.
Users may not reproduce, distribute or exploit any content from the platform without prior written permission.
- Limitation of Liability
To the fullest extent permitted by law, Lots to Shop shall not be liable for indirect, incidental or consequential losses arising from the use of the marketplace.
Nothing in this policy excludes liability where such exclusion is prohibited by applicable South African legislation.
- Force Majeure
Lots to Shop shall not be held liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, civil unrest, internet outages, government actions, pandemics or failures of third-party service providers.
- Severability
If any provision of this policy is declared invalid, unlawful or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remaining provisions, which shall continue in full force and effect.
- Changes to this Policy
Lots to Shop reserves the right to amend this Governing Law & Jurisdiction Policy at any time.
Updated versions will be published on our website and become effective upon publication unless otherwise stated.
Continued use of the marketplace after any amendments constitutes acceptance of the revised policy.
